Refund Eligibility

Refund eligibility depends on the status of the project, work already performed, resources committed, third-party costs, project-specific commercial terms and applicable law.

Introduction

This Refund Policy explains the circumstances in which payments made to Logibyte Technologies may qualify for a refund.

Because Logibyte Technologies primarily provides professional, digital, technology, consulting and custom-development services, project work may begin shortly after a proposal is accepted and payment is received. This may involve consultation, discovery, planning, design, development, technical configuration, resource allocation, third-party expenditure or other project activities.

Accordingly, refund eligibility depends upon the status of the engagement, work already performed, resources committed, third-party costs, the applicable proposal or Statement of Work (“SOW”), and applicable law.

This Refund Policy should be read together with our:

It should also be read together with the applicable Proposal, Quotation, SOW or Agreement. Where project-specific refund provisions have been agreed in writing, those provisions will apply to the relevant engagement to the extent of any inconsistency with this general policy.

General Refund Principle

Payments are not automatically refundable merely because a customer changes their mind, pauses a project or requests cancellation.

At the same time, Logibyte Technologies does not apply a blanket “no refunds under any circumstances” rule.

Refund eligibility will be assessed fairly according to:

  • Work Already Completed;
  • Services Already Delivered;
  • Approved or Accepted Milestones;
  • Time and Resources Already Committed;
  • Non-Recoverable Third-Party Expenses;
  • Project-Specific Contractual Terms;
  • Reason for Cancellation or Termination;
  • Amount of Prepaid Work Remaining Undelivered; and
  • Applicable Law.

Project Commencement

A project may be considered to have commenced when Logibyte Technologies begins one or more project-related activities after acceptance or payment.

These activities may include:

  • Discovery or Requirement Analysis;
  • Business or Technical Consultation;
  • Research;
  • Project Planning;
  • Information Architecture;
  • UI/UX or Design Work;
  • Software or Website Development;
  • Technical Configuration;
  • System Architecture;
  • CRM or Workflow Configuration;
  • Automation Development;
  • Integration Work;
  • Resource Allocation;
  • Project Management;
  • Testing or Quality Assurance; or
  • Procurement or Activation of Third-Party Services.

Once project work has commenced, the portion of payment attributable to work already performed or costs already committed will generally not qualify for refund, subject to applicable law.

Payments That Are Generally Non-Refundable

Subject to applicable law and any project-specific agreement, the following amounts will generally not be refundable once delivered, incurred, purchased, approved or consumed:

  • Completed Consultation;
  • Completed Discovery or Requirement Analysis;
  • Completed Design Work;
  • Completed Development Work;
  • Completed Customisation;
  • Approved or Accepted Deliverables;
  • Approved or Accepted Milestones;
  • Project Management Work Already Performed;
  • Technical Setup or Configuration Already Performed;
  • Resources Already Allocated or Consumed;
  • Domain Registration Costs;
  • Hosting or Cloud Services Already Purchased;
  • Third-Party Software Licences;
  • API or Integration Charges;
  • SaaS or Platform Charges;
  • Third-Party Professional Costs;
  • Non-Recoverable Payment or Banking Charges, where legally permissible; and
  • Other Non-Recoverable External Costs Incurred Specifically for the Customer’s Project.

Advance and Initial Payments

An advance or initial payment may be required to reserve resources and commence work.

Where work has not yet materially commenced and no material third-party cost or committed resource has been incurred, a customer may submit a refund request for review.

Where work has already commenced, the refund assessment will take into account:

  • Work Already Performed;
  • Time Already Spent;
  • Resources Already Allocated;
  • Third-Party Expenses;
  • Applicable Milestones; and
  • Any Remaining Prepaid but Undelivered Work.

Any refund, if eligible, may therefore be partial rather than the full amount originally paid.

Milestone-Based Projects

Where a project is divided into milestones:

  • Payments for completed and accepted milestones are generally non-refundable;
  • Work completed toward an active milestone may be chargeable;
  • Approved change requests may affect refund calculations;
  • Third-party expenses already incurred remain chargeable where applicable; and
  • Prepaid amounts relating solely to future undelivered milestones may be reviewed for refund eligibility.

Recurring, Maintenance and Support Services

Where a customer purchases a recurring maintenance, support or ongoing-service plan:

  • Fees relating to service periods already provided are generally non-refundable;
  • Cancellation ordinarily applies to future service periods rather than completed service periods;
  • Any notice period stated in the applicable agreement or plan remains applicable; and
  • Any prepaid unused service period may be reviewed according to the applicable commercial terms and law.

Duplicate or Erroneous Payments

Verified duplicate payments or payments received in error will be reviewed separately.

Where verification confirms that the same obligation was accidentally paid more than once, the duplicate amount will ordinarily be eligible for refund, subject to payment reconciliation and applicable law.

Customers should notify us promptly at Operation@LogibyteTechnologies.com and provide the relevant transaction details.

Failed or Unconfirmed Transactions

A debit appearing in a customer’s bank or card account does not necessarily mean Logibyte Technologies successfully received the payment.

Where a payment is shown as failed, pending or unconfirmed:

  • Customers should first check their bank or payment-provider status;
  • Logibyte Technologies may review available transaction records;
  • Automatically reversed payments do not require a separate merchant refund; and
  • If the payment is subsequently confirmed as successfully received by Logibyte Technologies, the matter will be handled according to the applicable transaction and refund rules.

Refund Where Logibyte Technologies Cancels an Engagement

If Logibyte Technologies terminates an engagement for reasons not caused by material customer breach, refund eligibility for prepaid but genuinely undelivered work will be assessed.

The assessment may deduct:

  • Completed Work;
  • Delivered Services;
  • Approved Milestones;
  • Time Already Spent;
  • Committed Resources; and
  • Non-Recoverable Third-Party Costs.

Where an engagement is terminated because of customer non-payment, unlawful instructions, fraud, abuse, material contractual breach or another customer-attributable reason, different contractual consequences may apply.

Dissatisfaction With Delivered Work

A refund is not automatically due solely because a customer expresses dissatisfaction after work has been performed.

Where a concern relates to:

  • An Agreed Deliverable;
  • An Approved Requirement;
  • A Technical Defect; or
  • A Failure to Meet the Agreed Scope,

the customer should first contact Logibyte Technologies and provide reasonable details of the issue.

Where appropriate under the applicable project terms, we may review whether the matter can be addressed through:

  • Correction;
  • Revision;
  • Rectification;
  • Re-Performance; or
  • Another Appropriate Remedy.

This does not affect rights that cannot lawfully be excluded.

How to Request a Refund

Refund requests should be submitted to: Operation@LogibyteTechnologies.com

The request should include, where applicable:

  • Customer or Company Name;
  • Registered Email Address;
  • Contact Number;
  • Project or Service Name;
  • Invoice Number;
  • Transaction Reference;
  • Payment Date;
  • Amount Paid;
  • Amount Requested for Refund;
  • Reason for the Request; and
  • Relevant Supporting Information.

Incomplete requests may require additional information before review can be completed.

Refund Review Timeline

Review Timeline

We aim to acknowledge a refund request within 2 Business Days.

We ordinarily aim to communicate an eligibility decision or meaningful update within 7 Business Days after receiving sufficient information to review the request.

Complex matters involving banks, payment gateways, card networks, international payments, third-party providers, contractual disputes or additional verification may require additional time.

Approved Refund Processing

Where a refund is approved, Logibyte Technologies will ordinarily initiate the approved refund within 7 Business Days after approval, subject to payment-provider, banking and technical availability.

Where reasonably possible, refunds will be returned to the original payment method.

After Logibyte Technologies initiates a refund, the time required for the amount to appear in the customer’s account depends on the relevant bank, payment gateway, payment processor, card network, payment method and country or currency involved.

For card and payment-gateway refunds, financial providers may require additional processing time after initiation. Cashfree, for example, currently states that bank-reflected refunds generally take about 5–7 working days after initiation, although actual timing may vary.

Logibyte Technologies cannot guarantee the processing time of an independent financial institution after a refund has been successfully initiated.

Refund Method

Where technically and legally possible, approved refunds will normally be processed to the original payment method.

A different refund method may be used only where:

  • The Original Method Cannot Accept the Refund;
  • The Relevant Payment Provider Requires Another Process;
  • Applicable Law Requires Another Method; or
  • Both Parties Legitimately Agree to an Alternative Method.

Additional verification may be required before any alternative refund method is used.

International Payments

Refunds relating to international payments may be affected by:

  • Currency Conversion;
  • Exchange Rates;
  • Correspondent-Bank Charges;
  • Payment-Processor Charges;
  • Card-Network Rules;
  • Regulatory Requirements; and
  • Banking Processing Times.

Where conversion occurs, the amount ultimately received in the customer’s local currency may differ from the original local-currency equivalent because of exchange-rate movements or independent financial-institution charges.

Logibyte Technologies does not control exchange rates applied by independent banks, card networks or payment processors.

Chargebacks and Payment Disputes

Customers are encouraged to contact Logibyte Technologies at Operation@LogibyteTechnologies.com before initiating a payment dispute, where reasonably possible, so that the issue can be investigated directly.

This does not restrict any lawful rights available to a customer through their bank, card issuer, payment provider or applicable law.

Where a payment dispute or chargeback is initiated, Logibyte Technologies may submit legitimate records relating to the transaction or service, including:

  • Invoices;
  • Payment Records;
  • Proposals;
  • Agreements;
  • Statements of Work;
  • Customer Communications;
  • Customer Approvals;
  • Project Records;
  • Service-Delivery Evidence; and
  • Other Relevant Documentation,

where permitted by applicable law and the dispute process.

Statutory Rights

Nothing in this Refund Policy is intended to exclude, restrict or override any consumer or statutory right that cannot lawfully be excluded.

Where applicable law provides greater rights than this policy, the applicable legal requirement will prevail.

Changes to This Refund Policy

Logibyte Technologies may update this Refund Policy to reflect changes in:

  • Services;
  • Commercial Practices;
  • Payment Processes;
  • Banking or Payment-Provider Requirements; or
  • Applicable Law.

The latest version will be published on our website with an updated revision date.
